These Terms of Service ("Terms") govern your access to and use of the Rare Binder platform at rare-binder.com (the "Service"), operated by Rare Binder ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding agreement;
• You are not located in a jurisdiction where use of the Service is prohibited by applicable law;
• You are not using the Service on behalf of a sanctioned individual or entity.

Rare Binder provides a platform for purchasing mystery packs that contain real, PSA or CGC professionally graded Pokémon trading cards. Cards are represented as Non-Fungible Tokens (NFTs) on the Solana blockchain. Key features include:

• Pack Purchases. Users purchase packs using USDC on the Solana network. Each pack reveals one graded Pokémon card NFT.
• 72-Hour Buyback. Within 72 hours of revealing a card, users may elect to sell it back to Rare Binder for approximately 85% of the card's insured value. See our Returns & Refunds Policy for details.
• Marketplace. Users may list, buy, and sell card NFTs via the on-chain marketplace.
• Physical Storage. Physical cards are held in the PSA Vault under professional, insured storage by Collectors Universe.

The Service operates on the Solana blockchain. To use the Service, you must connect a compatible Solana wallet (e.g., Phantom). You are solely responsible for:

• Maintaining the security of your wallet private keys and seed phrase;
• All transactions authorised from your wallet;
• Ensuring you have sufficient SOL for network fees and sufficient USDC for purchases;
• Any loss resulting from compromised wallet credentials.

We do not have custody of your wallet or assets. We cannot reverse, cancel, or modify on-chain transactions once submitted to the network.

All purchases are made in USDC on the Solana network. Prices displayed on the Service are inclusive of any platform fees. Solana network fees ("gas") are paid in SOL and are your responsibility.

We reserve the right to change pricing at any time. Price changes will not affect packs already purchased.

Upon successfully opening a pack, you receive an NFT representing ownership of the underlying physical graded card. Ownership of the NFT confers:

• The right to hold, transfer, and sell the NFT on compatible platforms;
• The right to exercise the 72-hour buyback option (subject to eligibility);
• Future rights to physical redemption when that feature becomes available.

Ownership does not include any intellectual property rights in the Pokémon card artwork, branding, or related materials, which remain the property of their respective owners.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to manipulate, exploit, or abuse any feature of the Service;
• Use automated bots, scripts, or other automated means to interact with the Service;
• Circumvent any security measures or access controls;
• Use the Service to launder money or finance illicit activities;
• Interfere with or disrupt the integrity or performance of the Service;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate access to the Service for any user who violates these Terms.

You acknowledge and accept the following risks inherent in using the Service:

• Price Volatility. The value of NFTs and USDC may fluctuate significantly. Past performance is not indicative of future results.
• Blockchain Risks. Blockchain networks may experience congestion, forks, or failures beyond our control.
• Smart Contract Risk. Despite security measures, smart contracts may contain vulnerabilities.
• Regulatory Risk. Regulatory changes in your jurisdiction may affect your ability to use the Service.
• Gacha / Random Nature. Pack contents are determined randomly. There is no guarantee of any specific card being received.

All content on the Service — including but not limited to the Rare Binder brand, logo, website design, and software — is the intellectual property of Rare Binder or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

Pokémon and all related names, trademarks, and imagery are the property of Nintendo / Creatures Inc. / GAME FREAK inc. Rare Binder is not affiliated with or endorsed by Nintendo, The Pokémon Company, PSA, or CGC.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RARE BINDER, ITS DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Rare Binder and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Any on-chain assets in your wallet remain yours.
